We are excited to announce that we are launching a new free legal clinic to assist undocumented parents in fear of detainment or deportation in making provisional custody arrangements for their children.
A provisional custody by mandate affidavit is a statutory creation that allows a custodial parent or legal guardian to transfer custody of a child or children to a relative or friend for a period of up to one year.
Importantly, both the child and the party receiving custody would need some form of legal status in order to protect them from detainment or deportation, as well. While legal custody transfers at the time of signing, the parent and party receiving custody can elect to have the child or children remain in the parent’s home as long as the parent is able.
Our first clinic is scheduled for Friday, 14 July, 2017 from 10 AM to 12 PM at the Hispanic Resource Center, 4312 Florida Avenue in Kenner. The clinic is walk-in and first-come-first-served. We also need people to serve as Spanish translators, should you know anyone who might be interested in volunteering.
